Richard S. Pitts will join OAPSLO on Thursday, Nov. 4th for an informative webinar on “A New Look at Dram Shop and Gram Shop Liability” . This program is approved for 1 hour of CE.
Rick Pitts serves as Vice-President and General Counsel to Arlington/Roe & Co., Inc., an insurance brokerage and managing general agent headquartered in Indianapolis. Rick also serves as general counsel to the Independent Insurance Agents of Indiana, Inc., as well as its sister organization in Kentucky. Rick speaks annually at the “Roadshows” in Kentucky and Indiana’s Agency Compliance Seminars and presents various seminars on insurance and employment related matters. He has presented continuing education seminars to insurance professionals nationally through industry groups including the National Alliance for Insurance Education and Research.
The webinar begins with a description of some of the current issues in liquor liability and a view of the statistics showing the nature and extent of the risk, including recent jury verdicts. The next segment focuses on state law, both case and statutory, that creates the liquor liability. The laws and liability landscape are discussed, with focus on topics such as: does a homeowner have the same exposure as a professional bartender; and, how does evidence of blood alcohol content and consumption rates play out in real cases? Rick then presents information on the exclusions and limitations that exist under the most frequently used homeowner’s forms (for consumer-related issues) and business forms.
